With all the proposed activity on many insurance fronts related to health care reform, the use of credit information in rating and underwriting, and focus on life settlement regulation, it is important to note the focus in many states on some level of reform, or modification to, the business of workers’ compensation insurance. For example, Colorado Senate Bill 112 seeks to revise areas of current law regarding rate setting for workers’ compensation insurance. One section of the bill proposes to require the carrier to give the insured employer credit against the premium for the full amount of the deductible. Yet another section seeks to create additional transparency in workers’ compensation rate filings, by making the recommendations and supporting materials of the rating organization and the independent actuary employed by the commissioner of insurance, including any underlying reasons for rate changes, available to the public. In West Virginia, introduced Senate Bill 48 proposes the extension of permanent total disability benefits to claimants for life. Oklahoma is another state with some significant proposed changes.
